What is a living trust and why is it a good idea?
Many people have estates that are large enough to trigger probate proceedings unless they utilize a probate-avoidance mechanism. A living trust, also known as a revocable trust, is a great tool for people who don't want their loved ones to have to go through a long, confusing, and expensive probate process.
Living trusts are similar to wills, with one important difference - they avoid probate. This type of trust allows people to retain control over their assets while they are alive. When the initial trustee(s) pass away, the trust becomes irrevocable and the assets must be distributed as set forth in the trust documents. This usually can be done without the need to involve the probate court.
What is included with a trust package?
The trust packages created by the Law Office of Jennifer S. Knight are custom packages designed with each client's specific needs in mind. Rather than nickel and dimming clients for each important document, I provide comprehensive packages that address a variety of important concerns. Trust packages include the Trust Agreement and incidental documents, along with a pour-over will, a short form statutory power of attorney, an advance healthcare directive, final disposition instructions, and nomination of personal guardian for minor children (if applicable).
If hired to create a trust package, I currently provide one free home visit to areas within a 15 mile radius. I accept clients from all over California, and can provide services remotely as long as the client is available for email and phone conversations so that I can properly gather all of the necessary information.
